Terms of Service
Last updated: [June 2, 2026]

These Terms of Service govern your use of the Heart's Cellar website and your purchase of products from us. By accessing our website or placing an order, you agree to these Terms.

  1. About our products

Heart's Cellar offers personalised, made-to-order keepsake products, including question-based books and related story. Because these products are customised to each order, the experience includes customer input, proofing steps, production, and fulfilment workflows that differ from ordinary off-the-shelf retail purchases.

  1. Eligibility and accurany

You agree to provide accurate information when placing an order, submitting personalisation details, or contacting us. You are responsible for checking names, dates, custom wording, shipping details, and any other information you submit before approval and checkout.

If you provide information about another person, including a respondent or recipient, you confirm that you have the right to provide that information for the purpose of creating and delivering the product.

  1. Personalised content

You retain responsibility for the text, answers, recordings, images, and other content you submit or cause to be submitted in connection with your order. You confirm that your content does not infringe another person's rights, violate the law, or contain material you do not have permission to use.

We reserve the right to refuse, pause, or cancel an order if submitted content is unlawful, abusive, infringing, unsafe, technically unusable, or outside the scope of our service.

  1. Orders and payment

All orders are subject to acceptance and availability. Prices, product descriptions, optional extras, and shipping charges may change from time to time, but the amount charged at checkout will be the amount applicable to your order unless there is an obvious pricing error.

Shipping fees are calculated at checkout based on destination and order details. We ship worldwide where our delivery partners and fulfilment setup allow.

  1. Proof review and approval

For personalised products, we may provide a proof, preview, or approval stage before production. You are responsible for reviewing the proof carefully, including the cover title, wording, question order, highlighted quotes, front matter details, and any audio-page wording shown to you.

Once you approve a proof, production may begin and further changes may be limited or unavailable.

  1. Production and delivery timing

Delivery timing depends on several stages, including customer submission, respondent completion, proof approval, production, printing, and shipping. Any timeframes shown on the website or in emails are estimates rather than guarantees unless we clearly state otherwise.

We are not responsible for delays caused by incomplete submissions, delayed respondent answers, approval delays, customs, courier disruptions, force majeure events, or circumstances outside our reasonable control.

7. Returns, cancellations, and revisions

Because our products are personalised and made to order, returns and cancellations are limited. In general, orders may only be canceled before production begins, and personalised products are usually not eligible for return unless they arrive damaged, defective, or materially different from the approved proof.

If there is a production error, printing defect, or shipping damage, contact us within five days of delivery with your order number and clear photographs where relevant. We may, at our discretion, offer a replacement, correction, store credit, or another appropriate remedy.

  1. Intellectual property

All website content, branding, layouts, product systems, graphics, and service materials belonging to Heart's Cellar are protected by intellectual property laws and may not be copied, reproduced, or used without permission. This does not include personal content you submit, except to the extent necessary for us to provide the services you requested.

By submitting content for an order, you grant us a limited right to use, store, edit, format, reproduce, and process that content solely for the purpose of creating, fulfilling, and supporting your order.

  1. Website use

You agree not to misuse the website, interfere with its operation, attempt unauthorized access, submit harmful code, or use the site for fraudulent or unlawful purposes. We may suspend or block access where necessary to protect the website, our customers, or our business.

10. Limitation of liability

To the fullest extent permitted by law, Heart's Cellar will not be liable for indirect, incidental, special, or consequential losses arising from your use of the website or purchase of our products. Our total liability relating to any order will generally not exceed the amount paid for that order, except where applicable law does not allow such a limitation.

  1. Governing law

These Terms are governed by the laws of Hong Kong, unless another law must apply by operation of mandatory consumer protection rules. Any disputes will be handled in accordance with applicable Hong Kong law, subject to any non-excludable consumer rights.

  1. Changes to these terms

We may update these Terms of Service from time to time by posting the revised version on our website. Continued use of the website after changes take effect means you accept the updated Terms.
